Terms of Sale

These Terms of Sale set out the conditions under which Holly Forge Farming (“we”, “us”, “our”) supplies machinery and equipment to customers (“you”, “your”). By purchasing from us, you agree to these terms.

1. General

Holly Forge Farming is a business based in North Yorkshire, UK, specialising in the sale and sourcing of used agricultural and plant machinery.
All sales are made on the understanding that the buyer has read and accepted these Terms of Sale.

2. Descriptions and Condition

• All machinery and equipment are sold as seen, unless otherwise stated in writing.
• Descriptions and photographs are provided in good faith and to the best of our knowledge, but they do not form part of any contract.
• You are responsible for ensuring that the machinery is suitable for your intended use.
• Viewing and inspection are strongly encouraged before purchase.

3. Pricing

• All prices are stated exclusive of VAT, unless otherwise noted.
• VAT will be charged at the current UK rate where applicable.
• We reserve the right to amend prices without notice prior to sale confirmation.

4. Payment

• Full payment must be received and cleared before collection or delivery of goods.
• Accepted payment methods: bank transfer, cleared cheque, or cash (up to the legal limit)
• Ownership of goods remains with Holly Forge Farming until full payment has been received.

5. Collection and Delivery

• Machinery may be collected from our yard by arrangement.
• Delivery can be organised nationwide at additional cost — please contact us for a quote.
• Once collected or delivered, the risk in the goods passes to the buyer.

6. Warranty

• Unless expressly stated in writing, all machinery is sold without warranty, express or implied.
• We do not accept liability for any loss, damage, or costs arising after collection or delivery.

7. Returns and Cancellations

• As used machinery is sold as seen, returns are not accepted once the sale is completed.
• Deposits placed on machines are non-refundable unless otherwise agreed in writing.
• In exceptional cases, a return may be considered at our discretion and subject to inspection.

8. Finance and Sourcing

• Finance options are provided through trusted third-party partners.
• Any finance agreement is strictly between you and the finance provider.
• When sourcing machinery on your behalf, we act as an introducer or agent, not as the seller, unless otherwise stated.

9. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any indirect or consequential loss.
• Our total liability shall not exceed the purchase price of the machinery supplied.

10. Governing Law

These terms are governed by and interpreted in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
